In China, the child born in wedlock or out of wedlock can get China citizenship. But China doesn't allow a citizen to own China citizenship as well as another country's citizenship at the same time. So, if your child has got Philippine nationality, you must give up it and apply for Chinese nationality.

I'm not familiar with the nationality law of Philippines.According to it, as long as parent is Philippines, his or her child can get Philippine citizenship. You are a Chinese and your wife is a Philippine. Now, you reside in Philippines. According to Chinese nationality law, your child cannot get Chinese nationality. Your child can give up his original nationality and apply for Chinese nationality. However, this process is very difficult.

What should I do in order for me to apply HK Passport and ID? Does applying for HK Passport and ID requires me to stay at HK for sometime? Thanks.
May. 21,2009 23:32 Mr.Donald replied:
HK ID has certain requirements, one is you have to stay in HK for at least 7 years unless your parents hold HK ID card. For Mainland china, if you were chinese citizen before, you can apply for restoration. If you never be, you can apply for under the chinese nationality law, my suggestion is you need to go to chinese embassy now for further assistance.

Hi, I think we have the same problem. I'm also holding Philippine Passport and wants to apply for Chinese Passport. The point here is we can only give up our Philippine Passport once they issued our Chinese Passport otherwise we will become ALIEN anywhere..
I think we can still apply for chinese citizenship even if our parents died years already as long as your holding their original ID, passport, ACR, etc. I'm sure these documents are the supporting documents in order for us to apply for chinese citizenship because I already made my research on HK Immigration in line with China Law.
Are you already registered at Chinese birth registry department or not? Are you holding your original birth certificate (Chinese Citizen)?
My problem is: 1. My parents failed to register my birth at chinese embassy 2. I don't have ACR/ICR or I-card
What we should find out: 1. how to get the ACR/ICR or I-card 2. how can we register our birth at chinese embassy 3. how to apply for passport and ID

Seeing that you have become a Chinese citizen, your nationality is Chinese. So, when you go back to the United States, you have to apply for the Visa of the USA from the Embassy of the USA in China. That is to say, you will be not able to go there freely. Please remember once you get the citizenship of China, your original citizenship will be given up.

Whilst the chinese might hold that you give up your other citizenship, the US does not. Therefore, unless you actually have to waive it and prove you have removed your citizenship, then it should not be a problem.

You should ask USA immigration office.
May. 2,2009 21:32 Mr.Matt(USA) replied:
You will not automatically lose your US citizenship by taking out PRC citizenship. This will only occur for PRC purposes -- i.e., the PRC will not recognise your US citizenship and you must travel on a PRC passport when entering the PRC.
In the US, you have to formally renounce your citizenship, and this may only be done for certain, bona fide purposes (e.g., not for taxation purposes, etc.).
Have a look at the US Secretary of State website detailing privileges and responsibilities of US citizenship.
Good luck.

Can a child born out of China with parents both Chinese nationals hold both a Chinese passport and a passport of another country?

Mr.Wong(China) replied:
It's impossible to own a Chinese PR as well as another country's PR.

Ms.Ann(Philippines) replied:
China Law does not allow dual citizenship but you can register your birth at chinese embassy on your country and apply for passport and ID

can i still be a citizen of china even if my father who is a chinese citizen is already dead for 4 years. im only 19 years old and soon to be 20 years old.

Ms.Cora(China) replied:
Yes, probably, you can apply for the chinese citizenship because your father is Chinese, but first, you should give up your Philippines citizenship, because China does not recognize dual nationality. Wish you success!

i already have a philippine passport already, what must i do?? some people said that i cant have chinese citizenship already because my father is already dead... what now

Ms.Ann(Philippines) replied:
My problem is:
1. My parents failed to register my birth at chinese embassy
2. I don't have ACR/ICR or I-card
What we should find out:
1. how to get the ACR/ICR or I-card
2. how can we register our birth at chinese embassy
3. how to apply for passport and ID

If I become a Chinese citizen, but have family in the US and they are USA citizens, will I be able to come to the USA freely?
Apr. 11,2009 21:13
Ms.Evelyn(China) replied:
Seeing that you have become a Chinese citizen, your nationality is Chinese. So, when you go back to the United States, you have to apply for the Visa of the USA from the Embassy of the USA in China. That is to say, you will be not able to go there freely. Please remember once you get the citizenship of China, your original citizenship will be given up.

Mr.Jan(AUSTRALIA) replied:
If your other family members are US citizen, I do not think USA will deny your entry in any circumstances.
May. 5,2009 04:48
Mr.J(UK) replied:
Whilst the chinese might hold that you give up your other citizenship, the US does not. Therefore, unless you actually have to waive it and prove you have removed your citizenship, then it should not be a problem.
Also, they would not know if you reapplied in any case.

I am a naturalized US citizen. I am considering to work in China, but with family still in the US who are also US citizens. If I apply for Chinese citizenship and lose my US citizenship, can I get a greencard to enter the US freely? Thanks
Apr. 8,2009 00:14
Mr.Jan(Australia) replied:
You should ask USA immigration office.

Mr.Matt(USA) replied:
You will not automatically lose your US citizenship by taking out PRC citizenship. This will only occur for PRC purposes -- i.e., the PRC will not recognise your US citizenship and you must travel on a PRC passport when entering the PRC.
In the US, you have to formally renounce your citizenship, and this may only be done for certain, bona fide purposes (e.g., not for taxation purposes, etc.).
Have a look at the US Secretary of State website detailing privileges and responsibilities of US citizenship.
Good luck.

Mr.Humor(Malaysia) replied:
But I heard that many Chinese celebrities prefer to give up the Chinese nationality and get the another country's nationality like the United States, Singapore, Swiss and British. Anyway, we respect their own choices. It's not allowed to have both Chinese nationality and another country's nationality.
